As Is

Terms of Service

Last updated September 17, 2026 · Louisville, Kentucky, United States · support@asisrawdeals.com

These Terms of Service (“Terms”) are a binding agreement between you and the operator of As Is, doing business as As Is Raw Deals at https://www.asisrawdeals.com (“As Is,” “we,” “us”). As Is is operated from Louisville, Kentucky, United States. The filed legal entity name, registered office, and registered agent will be inserted when counsel provides them; until then, legal notices go to support@asisrawdeals.com. By creating an account, listing, bidding, buying, selling, or otherwise using the service, you agree to these Terms, the marketplace policies, and the Privacy Policy. If you do not agree, do not use the site. We may provide these Terms electronically; you consent to receive legal notices at the email on your account and at support@asisrawdeals.com.

If the site header shows DEMO MONEY, checkout, Connect, and postage are simulations. No real charge, transfer, or carrier label is purchased. The rest of these Terms still bind you (eligibility, as-is, prohibited items, IP, conduct). They also describe the live marketplace and apply in full the moment live payments are enabled on the host.

1. Eligibility and accounts

You must be 18 or older. The service is not directed to children. One natural person or legal entity, one account, unless we agree otherwise. You are responsible for your login, listings, and everything done on the account. Sellers who receive payouts must complete Stripe Express identity and bank onboarding. We may refuse, suspend, or close accounts that look like fraud, underage use, or a ban dodge.

2. What As Is is (and is not)

As Is is an online marketplace that connects buyers and sellers. Listings, photos, descriptions, packing, shipment, and the item itself are the seller’s. We are not the seller of the goods, not an auctioneer of record for title, not a carrier, not a warehouse, and not a repair shop. We do not take possession of items in the ordinary course.

Checkout runs through our Stripe account with a transfer to the seller’s connected Stripe Express account (destination charges / separate charges and transfers). Stripe is the payment processor. As Is is the merchant of record for the card charge. Sellers receive transfers of seller net, not a charge on their own Stripe account. That collection path does not make us the warrantor of the goods. Sellers are independent contractors, not employees or partners of As Is. We are not a bank, money transmitter, or escrow agent.

Under our Stripe Connect settings, As Is is responsible to the buyer and the card networks for refunds and chargebacks on charges we collect. We will claw back the seller (including reversing payouts and charging the connected account) for those amounts, plus fees we are allowed to keep under policy. Card networks can reverse a charge even when these Terms say the sale is final. Network rules win that fight; these Terms still govern who owes whom afterward.

3. As Is sales

Items are sold As Is, Where Is, With All Faults. TO THE MAXIMUM EXTENT PERMITTED BY LAW, SELLER AND AS IS DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND AUTHENTICITY AS TO CONDITION. There are no in-app returns, refunds, or marketplace credits for condition, missing parts, authenticity disputes a reasonable buyer would have seen in the photos, defects, or “I changed my mind.” Card networks may still reverse a charge; that is not an in-app return.

Only three platform exceptions:

  1. Package never arrives according to carrier tracking.
  2. Package arrives clearly empty (carrier weight vs listing).
  3. Buyer receives a completely different category of item than listed.

Details live on the As Is policy. Sellers who misrepresent an item can be banned and forfeit funds. Authenticity and condition fights outside those three exceptions are between buyer and seller. We may still reverse a payout if a card network forces a chargeback.

4. Fees, payouts, and tax

Platform fees are shown at listing and checkout and in the fee policy. Stripe’s processing fees apply to the full checkout amount (item + postage). Seller payouts stay on the platform until tracking shows delivered, then: about 24 hours for New / Up & Coming sellers; Trusted / Top sellers as disclosed (faster / instant transfer), then Stripe’s payout schedule to the bank. Invoice Board jobs at $2,000+ may split 50/50 (half on close, remainder on delivery) as shown in product. We may delay, reverse, or claw back payouts for fraud, never-arrives, chargebacks, or policy violations. You authorize As Is to instruct Stripe to transfer seller net to your Express account and to reverse or debit that account (including a negative balance) for buyer refunds, chargebacks, the three exceptions, fraud, and fees. Sellers also accept the Stripe Connected Account Agreement.

You are responsible for your own income, sales, and marketplace-facilitator taxes except where Stripe Tax or law requires us to collect and remit. When sales tax is calculated at checkout, that amount is collected as disclosed on the payment and remitted per Stripe Tax / applicable law. Fee schedules can change; the amount shown at the time of the listing or checkout controls that transaction.

5. Shipping

Buyer pays the carrier rate quoted at checkout. As Is does not keep a postage markup. Seller must ship on time with valid tracking. Risk of loss passes per carrier scan as described in policy, except the three exceptions. If the order never arrives per tracking, the buyer is refunded item + postage; As Is may keep platform fees; the seller is charged for any payout already received. Live postage is purchased only when we have enabled live money on the host; until then labels and charges are simulated and marked DEMO MONEY.

6. Prohibited use

You may not list, sell, buy, or ship prohibited items. The prohibited items policy is part of these Terms and is enforced at listing. We can remove listings, suspend or ban accounts, and forfeit funds for violations.

Absolute no (federal):

  • Counterfeit or copyright-infringed goods, pirated software/media, and unmarked replicas. Replicas must say REPLICA in the title and photos.
  • Controlled substances, illicit drugs, prescription medications, and drug paraphernalia.
  • Firearms, ammunition, explosives, and ATF-restricted weapons. We do not facilitate gun transfers.
  • Recalled products and hazardous materials that CPSC, DOT, or USPS forbid.

Also banned (processor / high-risk):

  • Alcohol, tobacco, nicotine, vaping products, and adult sexual content.
  • Gift cards, stored value, cryptocurrency as the item, bullion sold as metal, lottery and raffle tickets.
  • Live animals, human remains, ivory and protected animal parts, live plants and agricultural seeds, whole vehicles, and real estate.

No off-platform deals to dodge fees, multi-accounting to dodge bans, or harassment. Listing something prohibited is a material breach. We cooperate with lawful requests from rights holders and law enforcement.

7. Copyright and trademark notices (DMCA)

As Is respects intellectual property. To report claimed infringement, email support@asisrawdeals.com with:

  1. Your physical or electronic signature (typing your legal name is enough if you cannot sign).
  2. Identification of the copyrighted work or trademark.
  3. The listing URL and a description of the infringing material.
  4. Your name, mailing address, phone, and email.
  5. A statement that you have a good-faith belief the use is not authorized by the owner, its agent, or the law.
  6. A statement, under penalty of perjury, that the information is accurate and that you are the owner or authorized to act for the owner.

Designated agent for notices: As Is, Louisville, Kentucky, United States, support@asisrawdeals.com. We will remove or disable matching listings. Repeat infringers are banned. If you believe your listing was removed by mistake, send a counter-notice with the same contact path.

8. Your content

You keep ownership of photos and text you upload. You grant As Is a worldwide, non-exclusive, royalty-free license to host, display, reproduce, and promote that content on the service and in marketing of the service. You represent you have the right to grant that license and that the content is not infringing or unlawful. We may remove content that violates these Terms.

9. Disputes between users

We do not mediate “not as described” condition fights outside the three exceptions. In-app messages are the channel until a sale is secured. Card network disputes are processed by Stripe. Opening a chargeback for a reason these Terms do not cover may result in us fighting the dispute, restricting the account, and recovering our costs from you.

10. Suspension and termination

You may close your account by emailing support@asisrawdeals.com. We may suspend or terminate access immediately for fraud, prohibited items, chargeback abuse, unpaid clawbacks, or any material breach. Surviving sections: fees owed, clawbacks, licenses already granted for completed sales, indemnity, disclaimers, liability limits, and dispute terms.

11. Disclaimer

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. WE ARE NOT RESPONSIBLE FOR THE QUALITY, CONDITION, DAMAGE, AUTHENTICITY, TITLE, OR DELIVERY OF ITEMS EXCEPT AS EXPRESSLY STATED IN THE THREE EXCEPTIONS. SOME STATES DO NOT ALLOW CERTAIN DISCLAIMERS. IN THOSE STATES, THE DISCLAIMER APPLIES TO THE MAXIMUM EXTENT PERMITTED.

12. Limitation of liability

TO THE MAXIMUM EXTENT ALLOWED BY LAW, AS IS AND ITS OPERATORS ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (A) THE PLATFORM FEES YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, (B) THE AMOUNT OF THE DISPUTED ORDER ACTUALLY RECEIVED BY AS IS, OR (C) ONE HUNDRED U.S. DOLLARS ($100). THIS CAP DOES NOT LIMIT A CARD-NETWORK REFUND WE MUST PAY AS MERCHANT OF RECORD; WE PAY THAT AND THEN RECOVER FROM THE SELLER. THESE LIMITS DO NOT APPLY TO LIABILITY THAT CANNOT BE LIMITED UNDER KENTUCKY LAW, INCLUDING (WHERE APPLICABLE) OUR OWN GROSS NEGLIGENCE OR WILLFUL MISCONDUCT.

13. Indemnity

You will defend, indemnify, and hold harmless As Is and its operators from claims, damages, and reasonable attorneys’ fees arising from your listings, items, packing, shipment, tax, messages, IP, or violation of these Terms or law — including chargebacks and card-network assessments caused by your conduct.

14. Disputes with As Is

Send a written notice of dispute to support@asisrawdeals.com before filing. If we cannot resolve it within 30 days, exclusive venue is the state or federal courts located in Jefferson County, Kentucky, and these Terms are governed by the Commonwealth of Kentucky, United States, without regard to conflict-of-law rules. You and As Is waive a jury trial to the extent allowed. You may still bring an individual claim in small-claims court in Jefferson County, Kentucky. To the extent permitted by law, disputes must be brought only in an individual capacity, not as a class, collective, or representative action. If a court finds the class waiver unenforceable for a claim, that claim proceeds in court and the rest of this section still applies. Nothing here limits either party’s right to seek injunctive relief for IP or unauthorized access.

15. Miscellaneous

These Terms plus the posted policies are the entire agreement. We may assign the agreement (for example in a sale of the service); you may not assign without our consent. If a provision is unenforceable, the rest remains. A failure to enforce is not a waiver. Headings are for reading ease. Force majeure: we are not liable for delays caused by carriers, payment networks, hosting outages, or events beyond reasonable control. You agree these Terms and related records may be executed and delivered electronically (E-SIGN / UETA). You may not use the service if you are on an OFAC sanctions list or in a comprehensively sanctioned jurisdiction.

16. Changes

We may change these Terms. The date at the top is the current version. Material changes take effect when posted, or later if we state a date. Continued use after that is acceptance. If you do not agree, stop using the service and close the account.
